Hola César, thanks for your helpful analysis! One question- why is the Supreme Court taking on this case since birthright citizenship has been settled law under the 14th Amendment since Wong Kim Ark? Haven’t all the lower courts decided against Trump’s executive order? paz- Rene G.

As you suggest, there is no disagreement among the lower courts. All have decided against Trump. That said, Trump's attempt to narrow birthright citizenship is one of his signature policy issues and the Supreme Court gives extraordinary weight to matters of importance to the president (no matter who is occupying the White House). On top of that, I think there are likely a few votes for Trump.
