Moments ago, Chief Justice Roberts issued an administrative stay of the district court’s order commanding the Trump administration to return Kilmar Abrego García to the United States by the end of the day today. The administrative stay is supposed to give Abrego García’s lawyers time to respond to the government’s request that the Supreme Court vacate the district court’s injunction entirely. Roberts gave Abrego García’s legal team until 5:00 pm Eastern tomorrow, Tuesday, to file a response. They have already done so (presumably even before the administrative stay was issued and without Roberts realizing it). Given that, it’s possible for Roberts or the entire Supreme Court to weigh in again at any time.

My post today (April 17th) include this statement about Garcia (the post itself contains links to the facts cited).

"Trump certainly could return Garcia. In January he forced Colombia to accept repatriation flights by threatened punitive tariffs on its exports to the US. Likewise, he could threaten El Salvador by withholding the $6m he is paying for them to keep 238 prisoners.

In fact, Trump has done it before. In 2019 the INS accidentally deported Muneer Subaihani, a legal 25 year resident of the US, to Iraq. A federal judge ordered the Trump administration to return him. The administration had no idea where he was. Nonetheless, they made a serious search and found him hiding in a family home in Iraq. He was returned to the US a few weeks after being deported."
